Kim practices exclusively in the area of commercial and insolvency litigation, including contract disputes, injunctive relief, and troubled suppliers litigation in the automotive industry.

REPRESENTATIVE WORK

  • Representing the Royal Bank of Scotland with respect to a commercial contractual dispute
  • Representing the Royal Bank of Canada, HSBC Bank Canada and the National Bank of Canada with respect to enforcement of the banks' rights and remedies
  • Part of litigation team to the Chief Restructuring Advisor of Canwest Media Inc. in respect of certain CCAA claims
  • Assisted senior counsel acting on behalf of a committee of contesting bondholders in the BCE privatization with respect to drafting, and preparation of witnesses at both the Quebec Superior Court and Court of Appeal levels
  • Acted for KPMG Inc. in its capacity as trustee in bankruptcy of the Portus Group of Companies with respect to the recovery of preferential payments, as well as in the subsequent petitioning of Boaz Manor into bankruptcy
  • Worked with Bahamian counsel in successfully recovering $2.5 million used to fund a Directors' and Officers' Trust with respect to the Portus Group of Companies
  • Represented General Motors LLC in the recovery of its tooling from troubled parts suppliers and appointing a receiver

Kim is a member of The Advocates' Society, the Canadian Bar Association and the Ontario Bar Association, Civil Litigation Section. Kim is also involved with the Portuguese-Canadian Lawyers Association, particularly through mentoring children to encourage the pursuit of secondary and post-secondary education.
